Update on DOL Ruling

Dear CC Staff and Faculty Members,

As you know, this past summer, the Department of Labor published new overtime rules that were to be effective December 1, 2016. The proposed law directed which employees would be exempt from earning overtime wages, raising the salary threshold from $455 per week to $913 per week (about $47,476 per year). Since those rules were first published, the college has devoted significant time and effort to assure that we would be in compliance with the law by the deadline. On November 3, 2016, we notified all Colorado College employees whose employment status or base salary was being changed for this purpose.

Late in the afternoon of Tuesday, November 22, Judge Amos Mazzart of the United States District Court for the Eastern Division of Texas issued a temporary nationwide injunction halting the implementation of the new overtime rules. That court decision is subject to appeal. As a result of this ruling, the new rules will not take effect on December 1, the prior rules remain in effect, and the timing of a change in the rules, if any, is completely up in the air. Further changes are possible depending on the resolution of the lawsuit and the response of Congress and the new administration.

The bottom line is that the future in uncertain and, therefore, we are delaying our actions related to the proposed rules. We have notified all CC employees who would have been directly affected by the overtime rules of our decision to hold off on implementation until we have a clear picture of our legal obligations. I understand that this has been frustrating and confusing to many of you and I am very sympathetic. I hope that we soon have a definitive answer and can finally resolve this issue.
