How much leave am I entitled to under FMLA?

If you are an eligible employee, you are entitled to 12 weeks of leave for certain family and medical reasons during a 12-month period.

Does the 12 weeks need to be taken in a consecutive block of time?

You may use the time consecutively or intermittently or by reduced hours if a health-care provider prescribes such a leave.

How do I know if I am an eligible employee?

You are an eligible employee if you have worked for Colorado College for at least 12 months, and have worked for at least 1,250 hours over the previous 12 months, and work at a location where at least 50 employees are employed by CC within 75 miles.

How is the 12-month period calculated under FMLA?

Colorado College measures the 12-month period by a "rolling" 12-month period measured backward from the date an employee uses FMLA.

Does the law guarantee paid time off?

No. The FMLA only requires unpaid leave. However, Colorado College allows the employee to use accrued paid leave time, such as vacation or sick leave, for some or all of the FMLA leave period.

What do I need to do if I want to go out under FMLA?

You should contact Human Resources as well as complete the FMLA leave request form.

Does workers' compensation leave count against an employee's FMLA leave entitlement?

It can. FMLA leave and workers' compensation leave can run together, provided the reason for the absence is due to a qualifying serious illness or injury.

Can Colorado College count time on maternity leave as FMLA leave?

Yes. Pregnancy or maternity leave for the birth of a child would be considered a qualifying event and may be counted in the 12 weeks of leave.

Do I have to provide Colorado College my medical records for leave due to a serious health condition?

No. An employer may request medical certification confirming that a serious health condition exists, but may not require an employee to provide medical records.

Can Colorado College require me to return to work before I exhaust my leave?

Subject to certain limitations, Colorado College may deny the continuation of FMLA leave due to a serious health condition if you fail to fulfill any obligations to provide supporting medical certification. It is always a good idea to be in communication with Human Resources, as we want to work with you on any and all leave policies.
